Mankqunkquza Lending Services (Pty) Ltd ("we", "us", or "the Lender") is committed to protecting the privacy and confidentiality of personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and the Financial Intelligence Centre Act 38 of 2001 (FICA). This policy explains how we collect, use, store, and protect your personal information.

Personal Information We Collect

To provide micro-credit facilities and comply with statutory South African lending regulations, we collect the following categories of personal information from applicants and clients:

  • Identifying Information: Full names, South African national identity number, and nationality.
  • Contact Details: Cellular telephone number, email address, and verified residential address.
  • Financial Information: Bank account details for electronic disbursement, income history, and affordability documentation.
  • Credit & Payment History: Loan transaction history, balance records, and repayment performance.

Purpose of Lawful Processing

Under Section 11 of POPIA, we process personal information strictly for legitimate business and regulatory purposes:

  • Performing required FICA identity verification and client onboarding.
  • Conducting affordability assessments to prevent reckless lending pursuant to the National Credit Act.
  • Processing electronic loan disbursements and recording repayments.
  • Maintaining accurate accounting, audit, and tax records as required by South African law.
  • Communicating loan account statements, payment notifications, and legal notices.

Data Security & Retention

We maintain appropriate technical and organizational safeguards to prevent unauthorized access, loss, destruction, or damage to personal data. Access to staff management tools is role-restricted and secured with cryptographic authentication.

In terms of the National Credit Act and statutory accounting rules, loan records and client transaction data are retained for a minimum statutory period of 5 years following loan settlement.

Your Rights Under POPIA

As a data subject, you have the right to:

  • Request Access: Inquire whether we hold personal information about you and request a copy.
  • Request Correction: Request the rectification or updating of inaccurate, outdated, or incomplete data.
  • Lodge an Objection: Object to the processing of personal data on reasonable grounds, subject to statutory retention requirements.
  • Lodge a Complaint: Direct unresolved complaints to our Information Officer or the Information Regulator.
