Credit Provider Status
B. Mankqunkquza Lending Services (Pty) Ltd operates in full alignment with the statutory framework established by the National Credit Act No. 34 of 2005 and regulations set forth by the National Credit Regulator (NCR).
Responsible Lending Commitment
In strict compliance with Section 81 of the National Credit Act, we maintain a robust policy against reckless credit granting. Before entering into any credit agreement:
- We conduct mandatory affordability assessments to assess the consumer's financial means and existing debt obligations.
- We ensure that loan repayments will not result in financial over-indebtedness.
- We clearly explain the risks, costs, and terms of the loan so the consumer makes an informed borrowing decision.
Pre-Agreement Disclosure & Quotation
Prior to entering into an agreement, each prospective borrower receives a complete Short Term Loan Agreement Form specifying:
- The principal capital amount disbursed via transfer.
- The applicable monthly interest rate.
- The once-off initiation fee and recurring monthly service fee.
- Any applicable threshold surcharges.
- Statutory Value-Added Tax (VAT) amounts.
- The exact due date and total repayment amount payable.
All fees and interest charges are strictly capped within the statutory limits prescribed by the National Credit Act regulations.
Consumer Rights Under the NCA
As a credit consumer in South Africa, you have the right to:
- Apply for credit free from unfair discrimination.
- Receive loan documentation in clear and plain language.
- Receive written reasons if a credit application is declined.
- Settle your loan balance early without prohibitive penalty charges.
- Access free credit bureau records and dispute inaccurate listings.
Dispute Escalation & Ombudsman
If you have an unresolved complaint or inquiry regarding your credit agreement, you are encouraged to first contact our management team. If the matter is not resolved to your satisfaction, you may escalate the complaint to the statutory ombudsman or regulator:
